Explaining the Ethical Foundation of Cyberspace Regulation Based on the Theory of Proxy Culture

Abstract
Objective: Regulation is one of the fundamental requisites of governance, and good governance demands the proper regulation of affairs by the government and public institutions. Given the pivotal role of regulation in managing societal affairs- including the administration of cyberspace- it is essential to examine this subject from diverse perspectives. Our objective in the present article is to provide a new formulation of the ethical foundations of cyberspace regulation through the concept of “proxy culture”.
Method: From a macro-epistemological perspective, the methodology of the present study is grounded in a hermeneutic (interpretive) approach.
Results: Within the concept of proxy, a distinction must be drawn between a “proxy” and a “degenerate proxy.” A “degenerate proxy” is one that lacks either the aspect of “signification” or the aspect of “surrogation.” Cyberspace is not based on a “degenerate proxy” but rather on a “proxy culture”; consequently, it possesses both the characteristic of “signification” and that of “surrogation”, making it both a semiotic system and a vicarious system. This means that cyberspace websites and applications act on behalf of individuals (the aspect of surrogation) while simultaneously, owing to their sign-like character (the aspect of signification), keeping the individual mindful of their distance from reality. The ethics of cyberspace regulation must correspond to this “proxy culture”.
Conclusions: In many respects, cyberspace has assumed the role of an individual’s “proxy” or “vicar” to act within the real environment. This imposes specific and novel ethical responsibilities regarding cyberspace upon its stakeholders (programmers, software and network engineers, service providers, etc.). Regulation based on the proxy culture is a multi-layered and multi-dimensional regulation. In regulating cyberspace, one cannot merely rely on the measures of public and private institutions in managing user behavior; rather, it is necessary to focus on the internal forces and structures of cyberspace itself. Regulation can no longer focus solely on the management of symbols or the flow of information; instead, it must concentrate on the management of proxy actions. Since the distinction between the online and the offline has been dissolved in the “onlife” environment, and data have acquired a shared ontological nature with the realities they signify, monitoring the proper functioning of these proxies in their capacity as surrogates becomes a priority.
